Introduction

Active SOS, LLC ("Active SOS," "we," "us," or "our") operates the Active SOS patient alert notification platform, including the mobile application and the provider portal accessible at activesos.com (collectively, the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect information obtained through the Service.

By using the Service, you agree to the collection and use of information in accordance with this policy. If you do not agree, please discontinue use of the Service.

Active SOS is operated by Calm Water Trading, LLC dba Active SOS, headquartered in Oklahoma City, OK. For all privacy inquiries, contact support@activesos.com.
Section 2

Information We Collect

From Patients (App Users):

  • Name and mobile phone number
  • The name and location of the medical practice they are associated with
  • Health alert messages and status submissions entered in the app
  • Device identifiers and app usage data

From Physicians and Medical Staff (Portal Users):

  • Name, email address, and professional role
  • Practice name and organization code
  • Mobile phone number (required for SMS alert notifications during onboarding)
  • Login credentials and account activity

Automatically Collected:

  • IP address, browser type, device type
  • Pages visited, time and duration of visits
  • Cookies and similar tracking technologies (see Section 9)

How We Use Information

We use collected information to:

  • Operate and deliver the Active SOS patient alert notification service
  • Forward patient-submitted health alerts to the appropriate medical practice
  • Send SMS notifications to physicians and staff who have consented to receive them during onboarding
  • Authenticate users and manage accounts
  • Communicate service updates, support responses, and operational notices
  • Comply with legal obligations, including HIPAA where applicable
  • Improve platform functionality and user experience

We do not use personal information for advertising, affiliate marketing, or any third-party promotional purpose.

Section 4

SMS Messaging Program

This section describes our SMS notification program and complies with CTIA Messaging Principles, the Telephone Consumer Protection Act (TCPA), and A2P 10DLC carrier requirements.

Program Description

Active SOS sends operational SMS notifications exclusively to licensed physicians and authorized medical staff who have consented during practice onboarding. Messages notify recipients of patient-submitted health alerts and platform activity. This is not a marketing, promotional, or consumer outreach program.

Opt-In: SMS consent is a required step during provider portal onboarding. Each provider must enter their practice mobile number and acknowledge the SMS consent statement before their account is activated. Providers may reply STOP at any time to cease receiving messages. Evidence of the opt-in flow is available at activesos.com/sms-consent.

Opt-Out: Recipients may opt out of SMS notifications at any time by replying STOP to any Active SOS message. Upon receipt of STOP, we will immediately cease sending SMS messages to that number and send a single confirmation: "You have been unsubscribed from Active SOS patient alert notifications. No further messages will be sent. Contact your practice administrator to re-enroll."

Help: Recipients may reply HELP to any Active SOS message to receive support contact information: "Active SOS patient alert notifications. For help, contact support@activesos.com or visit activesos.com. Reply STOP to unsubscribe. Msg & data rates may apply."

Message Frequency: Message frequency varies depending on patient activity at your practice. There is no fixed message frequency.

Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier plan.

Non-Sharing of Mobile Numbers: We do not sell, rent, share, trade, or otherwise transfer mobile phone numbers or SMS consent data to any third party for marketing, promotional, or any other purpose. Mobile numbers are used solely to deliver operational patient alert notifications within the Active SOS platform.

Supported Carriers: Active SOS SMS notifications are delivered through major US carriers. Carrier support may vary. Active SOS is not responsible for delays or failures in message delivery attributable to carrier networks.

Section 4b

Protect SMS Program — School & Workplace Safety

Active SOS operates a separate SMS notification program for the Protect platform, which serves K-12 schools, colleges, and workplace organizations. The Protect SMS program functions under an institutional enrollment model that differs from the Connect provider program described above.

Institutional Enrollment

Authorized school or organization administrators enroll participant phone numbers directly through the Protect administrative portal. Individual students, staff, or workers do not self-register for SMS through a consumer portal. Enrollment and consent are managed by the institution pursuant to its own policies and, for K-12 schools, applicable FERPA obligations.

Types of Protect SMS messages:

  • Anonymous safety tip acknowledgments — confirming a tip was received by the school safety team
  • Worker check-in and check-out acknowledgments (workplace safety programs)
  • Campus or workplace safety alert notifications authorized by the institution
  • Overdue check-in escalation alerts (workplace safety programs)

Opt-Out: Recipients may reply STOP to any Active SOS Protect message at any time to unsubscribe. One confirmation will be sent and no further messages delivered to that number.

Message Frequency: Varies based on safety activity at the enrolled institution; typically low volume. Message & data rates may apply.

Non-Sharing of Mobile Numbers: Mobile phone numbers enrolled in the Protect program are used solely to deliver school and workplace safety alert notifications. We do not sell, rent, share, trade, or otherwise transfer Protect program phone numbers or enrollment records to any third party for marketing, promotional, or any other purpose.

Section 4c

VetProtect SMS Program — Veteran Support Text Line

Active SOS operates VetProtect, a text-message support and check-in service for veterans and their supporters, together with participating organizations such as ValorTech. VetProtect is separate from the Connect and Protect programs described above.

Contact-First Model

People opt in by contacting the organization's VetProtect number first: by texting any message, by texting START, or by sending an alert to the number through the Active SOS mobile app. We do not send texts to people who have not contacted us first.

Types of VetProtect SMS messages: replies from the organization's staff or peer support; receipt and check-in acknowledgments; local resource referrals; crisis resource information (such as 988, Veterans press 1, and 911); and START and STOP confirmations. VetProtect sends no marketing or promotional messages.

Information collected through VetProtect: your mobile phone number, the content and time of your messages, a location link if you send one (for example, from the Active SOS app), message delivery status, and a record of your opt-in and opt-out events. The participating organization may also record a name and notes you or its staff provide.

Who can see it: authorized staff of the participating organization, and Active SOS personnel who provide technical support. Authorized staff may use automated, AI-assisted summaries of message history to help prioritize follow-up; AI does not send messages to people. We use service providers for SMS delivery, cloud hosting, database services, and AI summarization, solely to operate the service, under agreements that do not allow them to use the data for their own purposes. Retention follows Section 8 and the participating organization's agreement with us.

Opt-Out: Reply STOP to any VetProtect message at any time. One confirmation will be sent and no further messages delivered to that number. Reply START to resubscribe.

Message Frequency: Varies with the conversation; typically low volume. Message and data rates may apply.

Monitoring Hours and Emergencies: Monitoring hours are set by each participating organization. VetProtect is not an emergency or crisis service and is not monitored 24/7 unless the organization states so. In an emergency call 911; for crisis support call or text 988 (Veterans: press 1, or text 838255).

Non-Sharing of Mobile Numbers: We do not sell, rent, share, trade, or otherwise transfer VetProtect mobile phone numbers, message content, or SMS consent data to any third party for marketing, promotional, or any other purpose.

Section 5

How We Share Information

Active SOS does not sell personal information. We share information only in the following limited circumstances:

  • Within Your Practice: Patient alert data is shared with the designated physician and staff at the patient's registered medical practice.
  • Service Providers: We use third-party vendors (including SMS delivery, cloud hosting, and database services) solely to operate the platform. These vendors are bound by contractual data processing agreements and may not use data for their own purposes.
  • Legal Requirements: We may disclose information if required by law, court order, or governmental authority, or to protect the rights and safety of our users or the public.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, personal information may be transferred. We will notify users via email or prominent notice on our website prior to such transfer.

We do not share, sell, or license personal data to advertisers, data brokers, affiliate marketers, or any third party for commercial purposes.

Section 6

HIPAA and Health Information

Active SOS serves medical practices and may process Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). Where Active SOS acts as a Business Associate to a covered entity (medical practice), we operate under a Business Associate Agreement (BAA) that governs the use and disclosure of PHI.

Patient health alert messages transmitted through the platform are treated as sensitive health information and are handled in accordance with applicable HIPAA requirements. We do not use or disclose PHI for any purpose other than providing the Service as described herein.

Healthcare providers using the Active SOS platform for Remote Patient Monitoring (RPM) should contact us at support@activesos.com to execute a Business Associate Agreement prior to enrolling patients.
Section 7

Data Security

We implement industry-standard technical and organizational measures to protect personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Encryption of data in transit (TLS 1.2+) and at rest (AES-256)
  • Role-based access controls limiting data access to authorized personnel
  • Secure cloud infrastructure with regular security reviews
  • Multi-factor authentication for portal access
  • Audit logging of access to sensitive data

No method of transmission over the internet is 100% secure. While we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security.

Section 8

Data Retention

We retain personal information for as long as necessary to provide the Service and fulfill the purposes described in this policy, or as required by law. Practice account data is retained while the practice remains an active Active SOS customer and for a reasonable period thereafter as required by applicable law. Patient alert data may be retained for the period required for medical record-keeping purposes under applicable state and federal law.

Upon request, we will delete personal information in accordance with our retention policies and applicable legal requirements. To request deletion, use our Delete Account form or contact support@activesos.com.

Section 9

Cookies and Tracking

The Active SOS website and portal use cookies and similar technologies to maintain user sessions, remember preferences, and analyze usage patterns. We use:

  • Essential Cookies: Required for the platform to function (authentication, session management)
  • Analytics Cookies: Used to understand how users interact with the platform (e.g., page views, feature usage)

You may configure your browser to refuse cookies; however, some features of the Service may not function properly without them.

Section 10

Your Rights and Choices

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate or incomplete information
  • Deletion: Request deletion of your personal information, subject to legal retention requirements — use our Delete Account form
  • Opt-Out of SMS: Reply STOP to any Active SOS SMS message, or contact us at support@activesos.com
  • Withdrawal of Consent: Where we rely on consent to process your information, you may withdraw consent at any time without affecting the lawfulness of prior processing

Section 11

Children's Privacy

The Active SOS Connect portal and Remote Patient Monitoring (RPM) services are designed for use by adult medical professionals and adult patients. For these services, we do not knowingly collect personal information directly from individuals under the age of 18. If we become aware that a minor has provided personal information without appropriate consent, we will take steps to delete such information promptly.

Active SOS Protect — School & Workplace Safety Program: The Protect platform is designed for deployment by accredited K-12 schools, colleges, and workplace organizations. In this context, individuals enrolled in the Protect program by an authorized institutional administrator may include students who are under 18 years of age. Active SOS does not collect personal information directly from minors — phone numbers and enrollment data are provided by the educational institution under its own consent procedures and, for K-12 schools, the Family Educational Rights and Privacy Act (FERPA). Active SOS acts as a service provider to the institution and processes that data solely to deliver school and workplace safety alert notifications. Parents or guardians with questions about their minor child's enrollment in a school's Active SOS Protect program should contact the school directly, or contact us at support@activesos.com.

Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify registered users via email and update the "Last Updated" date at the top of this page. Your continued use of the Service after the effective date of the revised policy constitutes your acceptance of the changes. We encourage you to review this policy periodically.
